By accessing or using 8AM ("the App"), operated by 8AM Holdings Inc. ("we," "our," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
8AM is a personal-development application that helps users articulate a vision for their lives, listen to it as audio, reflect daily and weekly, receive AI-powered coaching, and connect with a community of members.
The App uses third-party AI services to power voice transcription, vision parsing, audio synthesis, and coaching. AI-generated content is provided as guidance only and is not professional medical, mental-health, legal, or financial advice.
You must create an account to use the App. You agree to:
You must be at least 13 years old to use 8AM. By using the App, you represent that you meet this requirement. If you are between 13 and the age of majority in your jurisdiction, you may use the App only with the involvement of a parent or guardian.
During the closed beta, access is granted via single-use access codes distributed by 8AM. Sharing or reselling access codes is prohibited.

You retain ownership of content you create (goals, reflections, messages, profile information, vision script, vision-board prompts). By using the App, you grant 8AM a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting and processing only), and display your content as necessary to provide the service to you and other members.
Vision-board images, Master Vision audio, AI Coach responses, and other outputs are generated using artificial intelligence. While we strive for quality, AI-generated content may be inaccurate, biased, or unsuitable. Use your judgment when acting on AI suggestions. AI-generated content is not professional advice.
You may not post content that:
We reserve the right (but not the obligation) to monitor, review, edit, or remove any content, and to suspend or terminate accounts that violate these Terms. We provide in-app report and block controls. Reports are reviewed by our team. We do not pre-moderate every post but may act on reports.
8AM has zero tolerance for objectionable content (hate speech, sexual content involving minors, real-world threats, harassment) or abusive users. Reported content is reviewed within 24 hours. Confirmed violations result in content removal and account suspension or termination.
The App, including its design, source code, branding, audio, and original content (excluding user-generated content), is owned by 8AM and its licensors and is protected by intellectual property laws. You may not copy, modify, redistribute, or create derivative works without our prior written permission.
The 8AM name and logo are trademarks of 8AM Holdings Inc.
Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and share your information.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT:
8AM is not a substitute for professional medical, mental-health, legal, or financial advice. If you are experiencing a mental-health crisis, contact a qualified professional or your local emergency services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 8AM HOLDINGS INC., ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $50.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you.
You agree to indemnify and hold 8AM Holdings Inc. harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App, your content, or your violation of these Terms.
We may suspend or terminate your account if you:
You may delete your account at any time through Settings → Delete Account.
We may update these Terms from time to time. Material changes will be announced in the App and the "Last Updated" date will be revised. Your continued use of the App after a change constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of the App shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
If you reside in a jurisdiction where this choice of law is not enforceable, the laws of your jurisdiction will apply.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
